Court to Reexamine Decision That Permitted Trump to Deploy Military Forces to Oregon City

The ninth circuit court has maintained a ban on sending national guard in the Oregon city, following a latest legal decision.

Judicial Panel Agrees to Rehear Legal Matter

The ninth circuit court of appeals ruled on this week that it would reexamine the legal dispute concerning the president’s authority with an expanded panel of 11 judges. The court also vacated a previous ruling from a three-judge panel that had sided with the federal government.

Legal Saga Over Troop Deployment

This order represents the latest development in a protracted legal battle over whether the administration has the legal right and justification to deploy state military units in the city. Approximately 200 federalized guard members have been in limbo since the end of September when the mobilization attempt was started in response to ongoing demonstrations.

Conflicting Arguments

The administration has argued that government employees at the ICE facility in south Portland were under attack, while city and state officials assert that local officers have control of the circumstances.

Contrary to characterizations of Portland as “war ravaged”, locals have been sharing footage of scenic paths and a thriving food scene, and planning activities such as an Emergency Naked Bike Ride against the increased military presence.

Recent Legal Actions

The Tuesday ruling came after a US district judge in the city issued two legal injunctions this month – one blocking the federal control of the Oregon national guard, and another stopping the use of any national guard troops in the state, after attempts to evade the initial injunction by calling up out-of-state forces.

On Monday, the appeals court had temporarily suspended the initial decision – allowing command of 200 Oregon national guard – but the second ruling remained in place, preventing the actual deployment of the forces.

Full Panel Consideration

The latest ruling means the issue will be heard by the full court – with both rulings under consideration together – by a group of eleven justices.

“This decision demonstrates that the truth matters and that the judicial system are striving to ensure government responsibility. The founding document limits the executive authority, and local populations cannot be treated as a training ground for unchecked federal authority,” said the legal representative in a statement.

“The court is sending a clear message: the executive leader cannot dispatch the military into US cities unnecessarily. We will continue protecting state legislation, values, and sovereignty as this legal proceeding progresses and our fight continues in the judicial system.”
