The Failure of the 28-Article Peace Proposal for Ukraine: Why Peace Negotiations Continue to Stumble

Europe breathed a deep collective sigh of relief on Monday, as the crisis caused by the presentation of a new 28-article proposal for achieving ceasefire appeared – temporarily – to have been stabilised. A American diplomat spoke of "notable headway" after bilateral negotiations in Geneva. On Monday night, Moscow made its response: an extensive attack of aerial bombardment on Kyiv.

The Rhythm of Diplomacy and Destruction

The succession of contrasting events captured the bleak nature of the current period. By day, diplomatic battles are fought: optimistic declarations are issued from multiple capitals. Immense energy is allocated on restraining specific proposals. By night, Russian leadership brutally reminds the world that, for them, conflict continues to be the key method for achieving "peace".

Nighttime Reality

As military strikes unfolded into the early hours of Tuesday, the present situation of Ukraine's exposure was exposed. Ukraine is able to track missile launches from Russian territory, a ability provided through current data. From observation points, defense planes that had been scrambled to engage hostile cruise missiles flew past – modern combat jets delivered to Ukraine by Western partners.

Moments later, Kyiv's missile defense activated: defensive missiles targeted at a Russian ballistic missile. This was a modern interception technology at work, probably supplied through allied countries. Every firing shakes the surroundings, shaking the windows. The moment of terror quickly becomes grim resignation: maybe the incoming missile won't strike its target this time, preventing destruction from ruin and additional electricity failures.

Persistent Threats

Soon after, a automatic firearm fired at a unmanned aircraft close by, part of a defensive team – almost certainly allied-provided weaponry. Sadly, the shots failed to hit the enemy aircraft – it continued its flight toward its destination.

Intermittently, this carried on until dawn. Kyiv greeted the daybreak reports: several casualties, devastation and infrastructure problems in multiple buildings as a result of the nocturnal offensive. As customarily, everyone still continued their routines – living the war. But those entire period encapsulated Ukraine's critical military reliance on international aid – a need that regional partners are clearly incapable to replace in the near term.

Unsuccessful Negotiations

The 28-point plan from American leadership provoked deep reactions, controversy and deep concern – and temporarily diverted attention from Ukraine's largest corruption scandal in years. Yet, we have seen this script before, after earlier high-level meetings and bilateral conferences.

Every new approach from Washington follows the identical sequence: a negotiation push against Ukraine, which Kyiv, with partner nations, effectively counters. They stabilise the situation but never actually achieve victory. This pattern will, undoubtedly, continue.

Strategic Calculations

It is tempting to accuse certain parties of consistently pushing Moscow's conditions. But that does not seem to be the entire situation. US administration functions according to a principle understood by international relations experts: you cannot secure via talks what you have been unable to protect through force. The White House believes that it is unfeasible to pressure the Kremlin to surrender the land that it currently occupies in Ukraine's southern or eastern regions.

The challenge is that while acknowledging this situation, American administration does nothing to deter Moscow, through words or deeds, from thinking that the current condition will not shift further in its favour in the near future.

Opposing Positions

Therefore, the Kremlin is convinced that duration works to their advantage – that Ukraine and its allies are coming close to fatigue. Their motivation to accept conditions that does not give them the greatest potential benefit is close to zero. There may be many attempts to stop fighting, but they will carry on as long as Russia's government remains highly assured in the result.

On the contrary, Ukraine's government believes that Ukraine can still persist, slowly losing lives and land but avoiding a entire defensive failure until situations evolve in its favour.

Present Conditions

Factually, there are no real preconditions for a truce. Now, individual motivations are becoming relevant: leadership ambitions to negotiate peace and achieve global acclaim, and the government's twin challenges – on one hand, not to distance important partners, and on the other, to rally Ukrainians around the country's interests against any plan Kyiv finds unsuitable, so that their attention does not shift toward homefront challenges. And although their objective will now be considerably more difficult after recent developments, it remains quite doubtful that this will change their overall approach.

These opposing factors are guiding negotiations.

Assessment and Future

It took a mere seven days to terminate the proposed articles of the most recent proposal. Assertive and inconsistent approach of the matter by US administration, resistance by Ukraine and the other European countries, along with calming attempts of diplomats, and finally, current information leaks, all did their job.

While new plans based on old ideas are imminent, Kyiv, London and other European capitals should arrive at a critical understanding: Ukraine and Europe will only be able to fend off diplomatic offensives from Washington that are based on Russian demands and demonstrate particular unwillingness to alter the situation, if they maintain solidarity and enhance their military capacity at a significantly accelerated rate. If they do, no combination of diplomatic or military actions will be able to defeat them. In the meantime, Ukraine's ability to counter nocturnal attacks will, for the predictable period, primarily depend on ongoing international assistance.
